1.1 The use of PlanNav’s outdoor activities app (“App”) is subject to the terms and conditions outlined herein. By accessing or using the App, you agree to comply with these terms. If you do not agree with any part of these terms, refrain from using the App.

The User’s Duties

2.1 Users of the App (“User”) agree to utilize the services provided by PlanNav solely in accordance with this Agreement and for the intended purposes of the App.
2.2 The User undertakes the following duties:
  • To provide accurate, truthful, and up-to-date information to PlanNav.
  • Not to engage in any activities that may disrupt or interfere with the proper functioning of the App or the services provided by PlanNav.
  • To use the App in compliance with all applicable laws, regulations, and guidelines.
  • Not to share login credentials or account information with unauthorized parties.
  • To promptly report any technical issues or concerns related to the App to PlanNav.

Use of the Service

3.1 The User acknowledges that the App is designed to provide outdoor activity-related services, including navigation, route planning, and location tracking.
3.2 PlanNav is not liable for any inaccuracies, errors, or discrepancies in the information provided by the App. Users are advised to exercise caution and use their discretion when relying on the App for navigation or route planning purposes. Please be aware that the terrain might not precisely correspond to what is depicted on the map. It’s essential to remain vigilant and attentive to your surroundings.
3.3 Sailing: The charts in the app, based on official data as well as on other sources, provide assistance in navigation and are designed to facilitate the use of official charts and not to replace them. Only official charts for navigators contain all the information necessary for safe navigation and it is always the captain’s responsibility for their correct use and compliance with applicable laws.

Use of Direction Function:

4.1 Users of the direction function must exercise caution and be aware of their surroundings. It is important to understand that the directions provided are aimed at finding the shortest route to the destination, which may not always be the safest or most suitable route. Terrain and other factors could present challenges along the suggested path.
4.2 Liability Disclaimer: The provider of the direction function shall not be held liable for any accidents, injuries, or damages resulting from the use of the directions provided. Users assume full responsibility for their safety and well-being when utilizing the direction function.
4.3 User Responsibility: Users are encouraged to use their discretion and judgment when following the provided directions. It is recommended to consider alternative routes or additional sources of information, especially in unfamiliar or hazardous environments.
4.4 Acceptance of Terms: By using the direction function, users acknowledge that they have read and understood these terms and conditions, and agree to abide by them. Continued use of the service implies acceptance of any risks associated with relying on the provided directions.

Use of Compass

5.1 Ensuring that your compass is properly calibrated before use is crucial for accurate navigation. Here’s a simple guide to make sure your compass is set correctly:
  • Check the North Alignment: Before using your compass, verify that the needle is pointing towards magnetic north. You can do this by comparing it with a known reference point, such as a map with marked compass directions or a GPS device indicating north.
  • Calibrate for Deviation: Magnetic compasses can be affected by local magnetic fields, causing deviation from true north. If you’re in an area known for magnetic interference, such as near power lines or metal objects, you may need to calibrate your compass to correct for this deviation. Follow the manufacturer’s instructions for adjusting the compass to compensate for deviation.
  • Practice: Once your compass is properly calibrated, take some time to practice using it in familiar surroundings. This will help you become comfortable with interpreting the readings and navigating accurately.By following these steps and ensuring that your compass is set correctly before use, you can use it to provide accurate navigation information, helping you stay on course during your outdoor adventures.

Use of Compass with Magnetic Case or other magnetic objects

5.2 Please carefully review the following before utilizing a compass in conjunction with a magnetic case or other magnetic objects.
Your use of the compass with a magnetic case means that you are aware of the risks that may arise.
  • Navigation Errors: The presence of the magnetic case (magnetic objects) may generate a magnetic field that disrupts the compass needle’s alignment with true north. Consequently, users may experience navigation errors, ranging from minor deviations to significant misdirections. The extent of these errors depends on the strength of the magnetic field and its proximity to the compass.
  • Disorientation: Inaccurate compass readings stemming from magnetic interference can lead to user disorientation, particularly in unfamiliar or remote environments where precise navigation is essential. Users are advised to exercise caution and consider alternative navigation methods when faced with inaccurate readings.
  • Delayed Recognition: Users may not immediately recognize the interference caused by the magnetic case, potentially leading to delayed acknowledgment of inaccurate readings. This delay in recognition can exacerbate navigation errors and prolong the time required to correct one’s course.
  • Safety Concerns: The occurrence of navigation errors due to compass interference poses safety risks, especially in outdoor or wilderness settings where accurate direction finding is crucial for averting hazards, adverse weather conditions, or potential isolation. Users are urged to prioritize safety and utilize supplementary navigation aids if necessary.
  • Reliability Compromised: The reliability of the compass as a navigation tool is compromised when used alongside a magnetic case. Users may experience a loss of confidence in the compass’s accuracy, prompting them to seek alternative navigation methods or tools in challenging environments.
  • Equipment Damage: Prolonged exposure to the strong magnetic fields emanating from the magnetic case may result in damage to the compass or impairment of its long-term functionality. Users should take precautionary measures to safeguard the compass from such damage, including storing it separately from the magnetic case when not in use.

5.3 By opting to use the compass with the magnetic case, users acknowledge and assume the associated risks of potential interference. Users agree to employ the compass responsibly and in adherence to manufacturer instructions and best practices for navigation.
5.4 We hereby disclaim any liability for damages or losses incurred as a consequence of utilizing the compass with the magnetic case or other magnetic disruptions. Such damages or losses include, but are not limited to, navigation errors, disorientation, safety concerns, reliability issues, or equipment damage.

Term; Withdrawal by User; Termination of the Agreement and Cancellation of the Account

6.1 This Agreement is effective indefinitely until terminated by either party.
6.2 The User may withdraw from this Agreement and terminate their account with PlanNav at any time by following the instructions provided within the App.
6.3 PlanNav reserves the right to terminate this Agreement and/or suspend or cancel User accounts in the event of a breach of these terms or for any other reason deemed necessary by PlanNav.

Changes to the Agreement

7.1 PlanNav reserves the right to modify, amend, or update this Agreement at any time without prior notice. Users will be notified of any changes to the Agreement within the App.

Assignment of the Agreement

8.1 This Agreement may not be assigned or transferred by the User without the prior written consent of PlanNav.

Privacy and Protection of Personal Data

9.1 PlanNav is committed to protecting the privacy and personal data of its Users. The collection, use, and disclosure of User data are governed by PlanNav’s Privacy Policy.

Miscellaneous

10.1 This Agreement shall be governed by and construed in accordance with the laws of Norway.
10.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Oslo District Court.
10.3 If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By continuing to use PlanNav’s outdoor activities app, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree to these terms, do not continue to use the app.
